Creating the Model for the New Utility: A Case Study in Aligning Legislative Vision with Implementation of New Formula Rates

ComEd has just begun a 10-year, $2.6 billion grid modernization program, which was authorized by a historic law that was passed in 2011 by the Illinois legislature known as the Energy Infrastructure Modernization Act. However, the regulatory body that oversees ComEd's rates, the Illinois Commerce Commission (ICC), has just posed a significant challenge to the utility in issuing a ruling on October 3, 2012 that denies ComEd the ability to recover a significant portion of its planned investment for the grid (denying them roughly $100 million, annually).

Richard W. Cortright, Jr.
Managing Director, U.S. Utilities and Infrastructure Ratings Group, Standard & Poor's
Richard W. Cortright, Jr. is a managing director in Standard & Poor's U.S. Utilities and Infrastructure Ratings group, and is engaged in the analysis and communication of ratings on utility credits. Richard is a principal spokesperson for Standard & Poor's in the utility sector, and leads the department's efforts in communications with state commissions, their staffs and other related entities. His responsibilities also include maintaining the quality of ratings, meeting with utility management and investors, chairing rating committees, and contributing to Standard & Poor’s publications.

For the nine years prior to his current role, he was responsible for managing several Standard & Poor's analysts and maintaining the quality of ratings in the utility sector. Before joining Standard & Poor's, Richard was with The Chase Manhattan Bank’s Global Power Group as a vice president in the public utilities division. Previously, he concentrated on utilities at Irving Trust Co. and Swiss Bank Corp.

Richard holds a B.A. in history from Swarthmore College and an M.I.A. from the Columbia University School of International Affairs.

Lillian A. Federico
President, Regulatory Research Associates

Ms. Federico is a 1987 graduate of Drew University, where she received a Bachelor of Arts Degree in Psychology/Business Management. She joined RRA immediately upon her graduation from Drew as a junior financial analyst. While employed by RRA, she was awarded an MBA in Financial Management from Pace University in 1992. She was promoted to Senior Financial Analyst in 1992, Vice President in 1995, and Senior Vice President in 1998. RRA, previously a stand-alone entity, was acquired by SNL Financial in 2005, and in July 2011, Ms. Federico was named President of RRA, which is now a division of SNL Energy. In addition to overseeing the day-to-day operations of RRA, she participates in the firm's coverage of state utility regulation (specializing in the Delaware, District of Columbia, Illinois, Maryland, New Jersey, Oklahoma, Pennsylvania, Texas, Virginia and West Virginia jurisdictions), and is a contributor to the company's equity research effort.

Managing Director, Power and Utilities, PricewaterhouseCoopers

Alan Felsenthal has more than 35 years of experience working with utilities clients on accounting matters, rate cases, and a variety of special projects. Prior to rejoining PricewaterhouseCoopers, LLP in 2010, Alan most recently was a managing director at Huron Consulting Group focusing on the utilities industry (2008-2010). Prior to that, he worked as a managing director at PwC in the utilities industry practice (2002-2008) and prior to that, rose through the ranks at Arthur Andersen LLP’s utilities and telecommunications practice (1971-2002). Education and certification: Bachelor of Science, Business Administration, University of Illinois, Urbana, Illinois; Certified Public Accountant, Illinois, Member AICPA.
